These terms and conditions (“Agreement”) govern the provision of appliance repair services by 5000770 Ontario Inc, doing business as “Prime Appliance Repairs” (“we,” “us,” or “our”) to you, the customer (“you” or “customer”). By using our services, you agree to be bound by these terms and conditions. It is your responsibility to familiarize yourself with this Agreement prior to allowing our technician to begin work. Allowing our technician to commence service constitutes acceptance of this Agreement in its entirety.

1. INTRODUCTION
These terms and conditions govern the provision of appliance repair services by Prime Appliance Repairs/5000770 Ontario Inc to the customer. By using our services, you acknowledge and agree to be bound by these terms and conditions.

2. APPOINTMENTS
We will make every effort to arrive at the scheduled time. In the event that we are running late, we will contact you to inform you of the delay. If we are unable to keep the appointment for any reason, we will contact you to reschedule.

3. SERVICE CALL FEE
A service call fee will be charged for each visit to your home, even if the repair is not completed. The service call fee covers the time technician leaves the office to travel to the job and the time required to analyze the problem (excluding the repair). The service call fee will also be charged in cases where the customer does not wish to proceed with the job. However, if the customer accepts our quote, pays a deposit, and authorizes us to perform the job, the service call fee will be waived. The service call fee is non-refundable.

The customer will be responsible for the service call fee if the problem is caused, or possibly caused, by a source other than the appliance itself, such as installation issues, plumbing issues, electrical issues, venting duct clogged, or any other issue not related to the appliance.

Customer shall provide suitable parking for our technician.

The service call fees for Electric Appliances are as follows (please note that these fees may differ based on the service location and the brand):

– First appliance: $99 + HST
– Additional appliances in the same household: $30 + HST each

The service call fees for Gas Appliances are as follows (please note that these fees may differ based on the service location and the brand):

– First appliance: $129 + HST
– Additional appliances in the same household: $40 + HST each

4. ESTIMATES
We will provide you with an estimate for the repair, including parts and labor, before starting any work. If additional problems are discovered during the repair, we will provide you with an updated estimate for your approval.

5. APPROVAL OF REPAIR
You must approve the repair estimate before any work can commence. If you decline the repair estimate, you will be responsible for the service call fee.

6. COMPLETED REPAIR
The repair is considered completed if you have paid for it in full and/or signed the acceptance form. Payment in full indicates that you have reviewed and tested the appliance, and the service is completed to your satisfaction. We offer no refunds on completed or ongoing repairs.

7. LIABILITY RELEASE
By using our services, you agree to release Prime Appliance Repairs and its owners, employees, and technicians from any and all liability, express and implied, arising out of damages and expenses of any kind resulting from the repair of your appliance(s).

8. CUSTOMER RESPONSIBILITIES
Somebody 18 years of age or older must be present at the time of service.

You must have a valid form of payment readily available at all times during the technician’s scheduled visit. We do not accept cheques.

Our technician must have unrestricted easy access to the appliance without interference from children, pets, and other distractions.

Customers shall not smoke cigarettes near the technician.

9. PAYMENT
All work must be paid for upon completion of the job. If any amount remains overdue, it will incur a late fee calculated and compounded monthly at the average bank of Canada rate plus 3% or 48% per annum (whichever is lower). This fee accrues from the due date and continues until the payment is received. You agree to pay all collection expenses, including attorneys’ fees.

10. INSTALLATION CHARGE
Our standard installation charge covers the removal and/or installation of an appliance without the need to disturb/remove any other fixture. Repair or modification of gas, water, ventilation, or electrical systems is not included. We do not verify the regulatory compliance of such systems; it is your sole responsibility. The installation charge quoted does not include the cost of materials such as vent hoses, water lines, gas lines, hoses, fittings, etc. If a second person is required to install an appliance (e.g., stacked washer and dryer), an additional charge will apply. The service call fee will be charged if the installation cannot proceed during the scheduled time.

11. PARTS
We only use original OEM parts. If the parts we use fail during the warranty period, we will pay for replacement parts. If parts fail due to normal wear and tear outside of the warranty period, we will charge our regular rate for replacement parts and labor. Shipping or handling of parts is non-refundable. Electrical or special-order parts cannot be returned.

12. RECOMMENDATIONS
We are not responsible for any work that is not performed by us, even if you follow our recommendations.

13. WARRANTY
Our 180-day warranty covers only the same problem that we attempted to repair. It does not cover any other problems, repairs performed by others, or malfunctions that were not caused by our errors (e.g., weather damage, pests). This warranty is exclusive to you and cannot be transferred to anyone else. It is void in case of improper appliance usage, maintenance, or relocation. A service call will be charged if a service technician is dispatched more than once to address the same warranty issue but cannot find a defect or if it turns out to be outside the warranty. We reserve the right to decide whether to offer a warranty. If our technician investigates the malfunction(s) and finds secondary issue(s) unrelated to the workmanship performed by our technician, we will provide you with a quote on the cost(s) associated with the repair. No refund will be issued on labor or parts already provided. Partial refunds can be offered at our discretion. There is no warranty on damage caused by external problems or interference by anyone else (other than our technicians) sensing or tampering with the repair.

Please note that the warranty needs to be activated. Customers will receive a 4-month warranty on repairs and parts once they leave feedback through the link they received on their mobile device upon job completion. Customers may have the option to increase their warranty by an additional 2 months by following additional instructions after completing the initial feedback survey, potentially increasing the warranty to 6 months in total.

14. LIMITATION OF LIABILITY
We shall not be liable for any amounts that exceed our service fees collected from the customer. IN NO EVENT WILL EITHER PARTY TO THESE TERMS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY IN CONNECTION WITH THESE TERMS AND CONDITIONS. THE WARRANTY SET FORTH IN THESE TERMS IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

15. WARRANTY / EXTENDED WARRANTY / SERVICE CONTRACT
This repair will be made for due consideration. You confirm that this repair will be paid for by the manufacturer warranty, extended warranty, or service agreement. You agree that your liability for the cost of this repair is not waived and agree to be personally responsible for the cost of this repair in the event the manufacturer, service contract company, or extended warranty provider fails to pay any portion of the full amount of these charges based on warranty limitations (it is your responsibility to familiarize yourself with the manufacturer/extended warranty/service agreement warranty limitation), or if the warranty provider fails to make payment. In the event that you are directly billed for all or a portion of the cost of this repair, you agree to remit said charges within 10 days of the billing date, as well as the reasonable cost of collection, including any attorney fees.

16. DAMAGE WAIVERS
We are not responsible for damage caused by:

a) Moving the appliance. In a case where a technician is required to move the appliance, we cannot be held liable for resulting damages.

b) Water leaks. You understand the risks inherent in working on appliances connected to the building’s plumbing system. Accordingly, we shall not be liable for unintended leakage and flooding.

c) Defective cooling.

d) Lifting the glass cooktop to access parts under it can result in breakage for which we will not be liable.

17. REFUSAL OF SERVICE
We reserve the right to refuse service to anyone using our reasonable discretion, particularly in cases of disrespectful or disruptive customers or danger to the technician. A service call fee can be charged for services refused due to the customer’s fault.

18. METHODS OF PAYMENT
Please note that we only accept credit cards and Visa/MasterCard debit.

19. REFUNDS
All transactions, transfers, sales, parts, and services are final unless otherwise authorized in official writing by a manager or supervisor. No returns are authorized unless specifically approved in writing by a manager or supervisor.

20. CREDIT/DEBIT CARD DISPUTES AND CREDIT/DEBIT CARD CHARGEBACKS
The customer agrees not to dispute credit card charges for any reasons, including the following:

Unauthorized transaction on the card (this invoice serves as proof of the charge on the card).
Double charges for the same transaction (this invoice serves as proof of the charge on the card and any double charges will be displayed in the invoice. In this case, a refund will be initiated only from our platform).

Charge for an incorrect amount (this invoice serves as proof of the charge on the card).
Unrecognized charge (this invoice serves as proof of the charge on the card).
Continued charge for a service that was canceled (this invoice serves as proof of the charge on the card).

Failure to receive a product or service paid for (this invoice serves as proof of the charge on the card).

If there is a dispute for any reason, the customer agrees to grant Prime Appliance Repairs/5000770 Ontario Inc. the right of way in the dispute and agrees to withdraw the dispute claim with the credit card issuer.

Prime Appliance Repairs/5000770 Ontario Inc. reserves the right to apply administrative fees of up to $600 in addition to the original invoice in the case of any disputes initiated on the customer’s behalf.

The customer agrees to pay all associated collections and legal costs and fees incurred due to lost disputes.

21. ADMINISTRATIVE CHARGES AND INTEREST ACCRUAL FOR UNPAID INVOICES
All invoices must be paid immediately upon job completion. If the invoice is not paid at the time of job completion, the following administrative and interest fees will apply:

Interest is calculated and compounded monthly at the average bank of Canada rate plus 3% or 48% per annum (whichever is lower) and is payable on that amount. It accrues during the period beginning on the due date and ending on the day before the day on which payment is received.
An administrative charge and late penalty fee of up to $600 will be automatically applied to the original invoice due date. Please note that all transactions, transfers, sales, parts, and services are final unless otherwise authorized in official writing by a manager or supervisor.

22. COLLECTION COSTS
If we incur any legal fees, costs, and disbursements in an effort to collect our invoices, you agree to reimburse us for these expenses, in addition to interest on the unpaid balance.
